Tom's Java Jive Terms of Service
These terms govern your use of tomsjavajive.com and any order you place with Tom's Java Jive ("we", "us"). By using the site or placing an order, you agree to them.
Effective date: November 5, 2026
Eligibility. You must be at least 18, or have a parent or guardian's permission, and be able to form a binding contract. Our privacy practices are described in our Privacy Policy, which is part of these terms.
Ordering and payment
Orders. Your order is an offer to buy. A contract forms when we send an order confirmation. We may decline or cancel an order, for example if an item is unavailable, a price is wrong, or we suspect fraud, and will refund any payment taken.
Pricing. Prices are in U.S. dollars and may change without notice. Sales tax, shipping, and any delivery fees are shown at checkout before you pay.
Payment. You authorize us to charge your chosen payment method for the total. Payments are handled by Squarespace. You confirm you are authorized to use the payment method.
Pickup, delivery, and shipping. Pickup orders are ready at the time shown in your confirmation; please collect them promptly, as we may discard uncollected items. Delivery and shipping windows are estimates, not guarantees. Risk of loss passes to you on delivery to the address you provide, so please check it carefully.
Cancellations, refunds, and product information
Cancellations. You can cancel an order before we begin preparing it by contacting us right away at tomsjavajive@gmail.com or (817) 764-5007. Once preparation or roasting has started, we cannot cancel it.
Refunds. If your order is wrong, damaged, or not what you ordered, contact us within [7] days and we will remake, replace, or refund it. Freshly made drinks and food cannot be returned. Refunds go to the original payment method.
Allergens. Our products are prepared in a kitchen that handles milk, soy, nuts, wheat, and other allergens, so we cannot guarantee any item is allergen-free. If you have an allergy, tell us before ordering.
Product information. We try to keep descriptions, photos, and prices accurate, but errors can occur. Roast flavors and colors vary by batch.
Accounts, acceptable use, and intellectual property
Accounts. If you create an account, keep your login confidential and give accurate information. You are responsible for activity under your account. We may suspend accounts that violate these terms.
Acceptable use. Do not misuse the site: no fraud, false orders, hacking or scraping, interfering with its operation, or violating any law.
Our content. The Tom's Java Jive name, logo, text, photos, and design belong to us or our licensors. You may view them for personal use, but may not copy or use them commercially without written permission.
Your content. If you submit reviews or messages, you grant us a free, non-exclusive license to use them to operate and promote the business.
Disclaimers, liability, and general terms
Disclaimer. The site and products are provided "as is" and "as available", without warranties of any kind to the extent the law allows. We do not guarantee the site will be uninterrupted or error-free.
Limitation of liability. To the extent the law allows, we are not liable for indirect, incidental, or consequential damages. Our total liability for any claim is limited to the amount you paid for the order at issue. Nothing here limits liability that cannot be limited by law.
Indemnity. You agree to cover claims and costs arising from your misuse of the site or violation of these terms.
Governing law. These terms are governed by the laws of [State], and disputes will be heard in the courts of [County, State], unless the law requires otherwise.
Changes. We may update these terms by posting a new version with a new effective date. Continued use after that means you accept the changes. Orders already placed are covered by the terms in effect when you ordered.
Entire agreement. These terms and the Privacy Policy are the whole agreement between us. If a provision is unenforceable, the rest stays in effect.
